⚠️ Important 2026 Legislative Context
Pending change — not yet in force. Amendments reported to take effect in September 2026 are expected to introduce an exemption from this compensation requirement where a landlord gives at least 120 days' notice ending on the last day of a rental period or lease term. As of today, this exemption is not in effect — the standard compensation rules calculated above still apply regardless of how much notice is given. Confirm the current status directly with the Landlord and Tenant Board before relying on this.
Bad-faith eviction penalties increased. Since July 1, 2026, provincial offence fines for landlords who give an N12/N13 notice in bad faith — for example, not moving in or not completing the stated work — have doubled to a maximum of $100,000 for an individual and $500,000 for a corporation.
Since 2023 reforms, an N12 requires the landlord (or the purchaser, or a qualifying relative) to occupy the unit for at least one year, and the landlord must file a statutory declaration confirming the intended use with the N12 notice. A tenant who suspects a bad-faith eviction should keep records and speak with a lawyer or the LTB.
