📋 About Above Guideline Increases
An AGI lets a landlord apply to the LTB (Form L5) for a rent increase beyond the annual guideline, on three grounds: eligible capital expenditures (major repairs or replacements, like a new roof or elevator), extraordinary increases in municipal taxes or charges, or increased security service costs.
An AGI is not self-executing — a landlord cannot simply decide to charge above the guideline. It requires a successful application and order from the Landlord and Tenant Board, and tenants can dispute the application at a hearing.
The capital-expenditure portion of an AGI is capped at guideline + 3% per year. If the full justified increase exceeds that in a single year, it is phased in at up to 3% per year for up to 3 consecutive years.
