Court vs. Out-of-Court Resolution

Many civil disputes are better resolved outside the courtroom. Negotiation, mediation, and arbitration can achieve faster, less expensive, and more private outcomes than a full Superior Court proceeding. Construction Lien Claims

Ontario's Construction Act gives contractors, subcontractors, and suppliers a powerful remedy when they are not paid: the ability to register a lien against the property they improved. But the timelines are strict — a lien must be preserved within 60 days of the last date services or materials were supplied, and perfected within 90 days by commencing a court action.

Missing either deadline permanently extinguishes the lien. We act quickly to preserve and perfect construction liens, release lien holdbacks, pursue trust claims under the Act, and defend property owners against improper liens.

🏗️ The 60-day preservation deadline begins from the last date of supply — not the date of the invoice or the date payment was refused. Act immediately.

Real Estate & Mortgage Litigation

Real estate transactions occasionally fail — a buyer refuses to close, a seller misrepresents the property, or a party seeks to rescind a signed agreement. From My Experience: Civil Litigation Is a Business Decision — Treat It Like One

The first thing I tell every civil litigation client is this: a lawsuit is a business decision. You weigh the cost of pursuing the matter against the likelihood of recovery, the time involved, and the impact on your life or your business. My job is to give you an accurate picture of all of those factors — not to simply validate your instinct to fight.

I've handled hundreds of civil matters over the years, and the cases that go best for clients are the ones where we had a clear-eyed view of the goal from the beginning. Sometimes that means litigating hard and going all the way to judgment. Sometimes it means sending a well-drafted demand letter that resolves a dispute in two weeks. Sometimes it means advising a client not to sue at all, because the cost of proceeding would exceed any realistic recovery. That honest conversation — even when it's not what a client wants to hear — is what separates good legal advice from legal cheerleading.

On Limitation Periods

The issue I see trip people up most often in civil litigation is the limitation period. Under Ontario's Limitations Act, 2002, most civil claims must be started within two years of when the claimant knew — or ought to have known — about the claim. Two years sounds like a long time. It isn't. People hold back because they want to resolve things informally. They wait to see if a payment comes in. Then they come to see me three years after the breach occurred and I have to tell them their claim is time-barred. There is nothing I can do for them at that point. If you think you have a civil claim, get legal advice immediately — even if you're not certain you want to pursue it yet.

On Construction Liens

Construction lien matters are the most time-sensitive civil files we handle. The Construction Act's timelines are strict and unforgiving — 60 days to preserve the lien, 90 days to perfect it. These are not suggestions. Miss them, and the lien is extinguished permanently, no matter how legitimate your claim. If you are a contractor, subcontractor, or supplier who hasn't been paid, call us as soon as you realize there's a problem — not after you've waited another 30 days hoping the cheque will arrive.
