Ontario family law is governed by a layered framework of federal and provincial legislation. Understanding which laws apply to your situation — and which court has jurisdiction — is the first step to protecting your rights.

The Divorce Act (Federal)

The federal Divorce Act governs divorce in Canada. It applies only to legally married spouses and covers three areas: the granting of a divorce order, parenting arrangements (decision-making responsibility and parenting time), and spousal support. The 2021 amendments to the Divorce Act modernized the language around parenting, replacing “custody” and “access” with “decision-making responsibility” and “parenting time.”

In Toronto, divorce applications under the federal Act are filed at the Superior Court of Justice. The one-year separation period — the most common ground for divorce — can begin running immediately on separation, regardless of when you retain a lawyer.

The Family Law Act (Ontario)

Ontario's provincial Family Law Act governs property division (equalization of net family property), possession of the matrimonial home, domestic contracts (including separation agreements, marriage contracts, and cohabitation agreements), and spousal support for both married and qualifying common law partners.

Unlike the Divorce Act, the Family Law Act applies to common law partners (for spousal support purposes) but does not give common law partners automatic property rights. Married spouses have the right to equalization; common law partners must pursue claims based on unjust enrichment or trust principles — a significantly more complex and uncertain process.

Children's Law Reform Act (Ontario)

The Children's Law Reform Act (CLRA) governs custody and access for unmarried parents and parents separating without a divorce under provincial jurisdiction. Equalization of Net Family Property in Ontario

Under Ontario's Family Law Act, married spouses are entitled to an equalization of their net family property (NFP) on separation or divorce. Each spouse calculates their NFP — the value of all property owned at the date of separation, minus debts at separation, minus the value of property owned at the date of marriage. The spouse with the higher NFP pays the other half the difference as an equalization payment.

The calculation sounds straightforward but is frequently complex in practice. The matrimonial home is always included in NFP regardless of when it was acquired — even if one spouse owned it before the marriage. Excluded property (inheritances, gifts from third parties, pre-marriage assets) can be deducted only if they can be clearly traced and have not been commingled with family assets. Business interests, defined benefit pensions (including OMERS, OTPP, and HOOPP — common pension plans among Toronto public sector workers), and investment portfolios all require careful valuation and may require expert reports. The equalization process often takes months of financial disclosure and negotiation to complete accurately.
