Charged With
Assault in Toronto?
One Allegation Doesn't Define You.
Assault charges in Toronto often arise from a single chaotic moment — a bar altercation, a workplace dispute, a misunderstanding between neighbours. Legal Solutions Law Firm builds a thorough, evidence-based defence to protect your record.

Toronto Assault Charges: A Careful Look at What Actually Happened
Assault under Criminal Code s.266 covers a wide range of conduct — from intentionally applying force without consent, to threatening gestures, to impeding someone's movement. Many assault charges arise from mutual altercations, self-defence situations, or one-sided accounts that don't reflect the full picture.
Common defences include self-defence, defence of another person, consent (in certain contexts), and simply challenging whether the Crown can prove the incident happened as alleged beyond a reasonable doubt. Witness inconsistencies and incomplete evidence are frequently the difference between a conviction and a withdrawal.
Legal Solutions Law Firm reviews every assault file for these defences from day one. Call or text 416-274-2222 for a free, confidential consultation.
If you acted to protect yourself or someone else, that can be a complete defence to an assault charge.
We examine inconsistencies between witness statements, prior statements to police, and the physical evidence.
We obtain all Crown evidence — officer notes, witness statements, video, and medical records — to identify weaknesses in the case.

Road Rage Incident
A confrontation between drivers following a traffic dispute or near-collision.
Self-Defence Situation
A case where the accused acted to protect themselves or another person but was also charged.

From simple assault to more serious variations, we defend the full range of assault-related charges under the Criminal Code.
Our Approach
How We Defend Your Case
Call us any time — 24/7. We listen to your version of events and map out your defence at no cost.
If you are held in custody, we move immediately to secure your release and any necessary conditions.
We obtain all Crown disclosure — statements, video, medical records — and identify every weakness and inconsistency.
We negotiate directly with the Crown, often securing a withdrawal, peace bond, or discharge based on the strength of your defence.
If the Crown won't offer a fair deal, we bring a judge into the discussion to explore a better resolution.
If fighting the charge is the right strategy, we cross-examine witnesses and advance every available defence at trial.
Plain Language Legal Guide
Assault Charges — What You Need to Know
You've Been Charged — Say Nothing
Whether you believe you acted in self-defence or the allegation is entirely false, do not discuss the details with police without a lawyer present.
Anything you say — even an attempt to explain yourself — can be used against you and often complicates an otherwise strong defence.
Self-Defence Is a Complete Defence
Canadian law recognizes the right to use reasonable force to defend yourself or another person from an assault or threatened assault.
What counts as "reasonable" depends heavily on the specific facts — the perceived threat, the proportionality of the response, and the sequence of events.
Many Assault Cases Are One Person's Word Against Another
A significant number of assault allegations rest primarily on witness testimony rather than physical or video evidence. Inconsistencies between the complainant's statements and other evidence can be powerful.
We carefully compare every account against the physical evidence and any independent witnesses.
Crown Pretrial & Negotiated Resolutions
The majority of assault charges resolve through negotiation with the Crown rather than trial, particularly where there is a viable self-defence or credibility argument.
Common resolutions include a withdrawal, a peace bond, or a discharge — all of which avoid a permanent criminal record.
Why Full Disclosure Matters
We request every piece of evidence the Crown intends to rely on, including 911 calls, body-worn camera footage, medical records, and any prior statements.
Gaps or inconsistencies in this material are frequently the key to a successful defence.
Why a Record Matters So Much
A criminal record for assault can affect employment, professional licensing, and international travel — including denial of entry to the United States.
Fighting the charge properly, even in cases with some evidence against you, is almost always worth the effort given these long-term consequences.
Know the Process
Where Your Case Is Heard — Toronto Courts
Simple assault charges in Toronto are hybrid offences, typically heard at the Ontario Court of Justice unless the Crown elects to proceed by indictment.
Ontario Court of Justice — 10 Armoury Street
Toronto's criminal matters — including first appearances, bail hearings, and trials for summary and many indictable offences — are heard at 10 Armoury Street. This purpose-built courthouse opened in 2023, consolidating the criminal courts formerly split across Old City Hall and College Park into one 17-storey building, the largest courthouse in Ontario.
Superior Court of Justice — 361 University Avenue
More serious indictable matters and jury trials are heard at the Superior Court of Justice at 361 University Avenue, which houses both the Criminal and Family branches. This is a separate courthouse from 330 and 393 University Avenue, which handle Superior Court civil matters.

Potential Penalties
Simple assault is a hybrid offence — the Crown can proceed summarily or by indictment depending on the circumstances. The information below is general; your actual exposure depends on the specific facts of your case.
Maximum penalty of up to 2 years less a day in jail and/or a fine — the more common route for first-time, lower-severity matters.
Maximum penalty of up to 5 years imprisonment where the Crown proceeds by indictment.
A conviction results in a criminal record unless the matter resolves by discharge, peace bond, or withdrawal.
A large share of assault charges resolve through negotiation — withdrawal, peace bond, or discharge — without a trial or permanent record.

What Our Clients Say
I had a very positive experience with Legal Solutions Law Firm. Ryan represented me in a family court matter and provided excellent guidance and support throughout the entire process. I truly appreciated his dedication, responsiveness, and commitment to achieving the best possible outcome. I highly recommend Legal Solutions Law Firm and Ryan to anyone looking for a compassionate and experienced family lawyer.
We tried to defend ourselves in civil court, but ultimately decided to hire Ryan — and it was the wisest decision we have made in the last two years of hell with our condo managers. Ryan and his team have been exceptional: swift, sharp, on the ball, and always asking the right questions while making the right arguments to move our case forward to the Superior Court.
Ryan did an outstanding job on my case. He was clear, professional, and always kept me informed. Thanks to his hard work, my charges were dropped. I’m very grateful and highly recommend him.

I had such a stressful time trying to find legal help. I felt lost and hopeless when I got a notice to appear at the LTB. When I found Ryan, he stepped up and defended me. He’s knowledgeable about both the LTB and criminal law, and most importantly he’s tough! Exactly what I was looking for. I’m so glad I found him.
Ryan is a tough lawyer who defended us during a very difficult time. He helped me with a Landlord and Tenant Board issue. People told me to get a paralegal, but the ones I contacted either wouldn’t help or couldn’t communicate well in English. When I found Ryan, he explained the situation clearly and told me what to do. He showed up to the hearing tough and ready to go. I’m so glad I found him!
One of the best. Well poised, smart articulate. Know his stuff and one of the best lawyer out there to work with.

From My Experience: Most Assault Charges Have More Than One Side to the Story
Almost every assault case I've handled looks different once you actually dig into it. The initial police report tells one version of events — usually the complainant's — and it's easy to assume that's the whole picture. It rarely is.
What I Look For First
The first thing I do on every assault file is request full disclosure: witness statements, 911 calls, any video, medical records if relevant. Inconsistencies between what the complainant told police initially and what they say later are more common than people expect, and they matter enormously at trial.
Self-defence cases are particularly rewarding to work on because clients often don't realize how strong their position actually is until we lay out the sequence of events properly. If you've been charged with assault and believe you were defending yourself — or that the allegation simply isn't accurate — call me before you say anything further to anyone: 416-274-2222.
