Agreement Lawyers in Toronto
Clarity and Confidence Before You Say "I Do."
A prenuptial agreement is not a lack of trust — it is a practical financial conversation had before the wedding instead of after a difficult separation. Legal Solutions Law Firm drafts prenups designed to be fair, understood, and enforceable.
Prenuptial Agreements in Toronto
A Prenup Is a Marriage Contract
A prenuptial agreement — legally known in Ontario as a marriage contract when signed before the wedding — allows engaged couples to define their own financial rights and obligations in advance, rather than leaving everything to the default rules under the Family Law Act if the marriage later ends.
Prenups are increasingly common for couples of all financial backgrounds — not just the wealthy. They are especially valuable for couples where one or both partners own a business, have significant premarital assets, are entering a second marriage, have children from a previous relationship, or simply want clarity and reduced conflict going into the marriage.
For a prenup to hold up in Ontario, it must be signed with adequate time before the wedding, supported by full financial disclosure from both partners, and each partner must receive independent legal advice from their own lawyer. Legal Solutions Law Firm handles both drafting and independent legal advice for Ontario couples.
We work on your timeline, but recommend starting the process well before your wedding date to protect enforceability.
We draft agreements both partners genuinely understand — not one-sided documents designed to overwhelm.
If your partner's lawyer has drafted the agreement, we review it and provide the required independent advice.
Straightforward prenuptial agreements are commonly handled on a flat fee basis so you know your cost upfront.
Real-World Scenarios
Common Prenup Scenarios
Prenups come up in a wide range of engagements. These are some of the situations we regularly help Toronto couples work through before their wedding.
One Partner Already Owns a Home
One partner purchased a home before the engagement. A prenup can address whether that home — and its future increase in value — is treated as separate or shared property.
Marrying Later in Life With Established Assets
Couples marrying later in life often each bring pensions, investments, or property accumulated over a career. A prenup can preserve those pre-marriage assets for each partner.
International Couple Relocating to Toronto
Where one or both partners hold foreign assets or citizenship, a prenup can clarify how Ontario law will apply, reducing uncertainty if the couple later separates in a different jurisdiction.
Significant Debt Disparity Between Partners
Where one partner is entering the marriage with substantial debt, a prenup can specify that the debt remains that partner's sole responsibility rather than becoming a shared liability.
What We Handle
Why Couples Choose a Prenup
Every couple's reasons are different — here are the most common circumstances that lead engaged couples to seek a prenuptial agreement.
Our Approach
How We Handle Your Case
We discuss your assets, your wedding timeline, and your goals for the agreement — no charge, no obligation.
Both partners exchange full, honest disclosure of assets, debts, and income to support enforceability.
We draft terms reflecting your intentions in clear language both partners genuinely understand.
Your partner's independent lawyer reviews the draft, and we negotiate any changes both partners are comfortable with.
Each partner receives ILA confirming they understand the agreement and are signing voluntarily and with adequate time.
The agreement is formally executed well before the wedding date and stored securely for both partners.

Prenup Agreements — What You Need to Know
Start Early — Timing Really Matters
A prenup signed just days before the wedding is far more vulnerable to a future challenge based on duress or inadequate time to review the agreement. We recommend beginning the process at least two to three months before your wedding date.
Starting early also allows for a more thoughtful, less rushed conversation between partners — which tends to produce a stronger, fairer agreement overall.
Full Financial Disclosure Is Required
Both partners must disclose their significant assets, debts, and income at the time of signing. Hiding assets — even unintentionally — is one of the most common reasons a prenup is later set aside by a court.
We recommend attaching a full net worth statement to the agreement as a schedule, creating a clear record of what was actually disclosed.
You Each Need Your Own Lawyer
One lawyer cannot represent both partners in a prenup due to the inherent conflict of interest. Each partner needs independent legal advice confirming they understand the agreement's legal effect before signing.
This is not just a formality — it is one of the requirements that makes an Ontario prenup enforceable years later, when a court may be asked to review it.
It's a Conversation, Not a Confrontation
Many couples worry that raising a prenup will feel like an accusation of distrust. In practice, couples who approach the process together — openly discussing finances and goals — often find it strengthens communication before the marriage begins.
We aim to make the process as collaborative and low-conflict as the topic allows, focused on clarity rather than confrontation.
What a Prenup Cannot Do
A prenup cannot predetermine child custody or child support — Ontario courts always retain jurisdiction over the best interests of children regardless of what the agreement says.
It also cannot remove a spouse's right to possession of the matrimonial home during the marriage, though it can address how the home is treated financially if the marriage later ends.
Prenups Can Be Updated Later
A prenup is not necessarily permanent in its exact terms — it can be amended or replaced during the marriage as circumstances change, such as the birth of a child or a significant career change, as long as the same requirements are satisfied.
Some couples build a review clause directly into the agreement to prompt a conversation at a future date.
Know the Process
Where Your Case Is Heard — Toronto Courts
A prenup does not go before a judge to be signed — it is a private agreement finalized before your wedding. If its validity is challenged years later, that dispute is heard by the same Toronto courts that handle divorce and equalization claims.
Ontario Court of Justice — Family Court
Child protection, custody, access, and child support matters may be heard at the Ontario Court of Justice. Since September 2024, new Toronto family cases are filed at the courthouse assigned to your provincial electoral district — either 47 Sheppard Avenue East or 311 Jarvis Street.
Superior Court of Justice (Family Branch) — 361 University Avenue
Divorce and property division (equalization of net family property) require the Superior Court of Justice, located at 361 University Avenue, which also houses the Criminal branch. The Superior Court can also hear custody, access, and support matters.

What Our Clients Say
I had a very positive experience with Legal Solutions Law Firm. Ryan represented me in a family court matter and provided excellent guidance and support throughout the entire process. He was professional, knowledgeable, and always took the time to answer my questions and explain everything clearly. Family court matters can be stressful, but Ryan helped make the process much easier and gave me confidence every step of the way. I truly appreciated his dedication, responsiveness, and commitment to achieving the best possible outcome. I highly recommend Legal Solutions Law Firm and Ryan to anyone looking for a compassionate and experienced family lawyer.
We tried to defend ourselves in civil court, but ultimately decided to hire Ryan — and it was the wisest decision we have made in the last two years of hell with our condo managers. Ryan and his team have been exceptional: swift, sharp, on the ball, and always asking the right questions while making the right arguments to move our case forward to the Superior Court.
Ryan did an outstanding job on my case. He was clear, professional, and always kept me informed. Thanks to his hard work, my charges were dropped. I’m very grateful and highly recommend him.

I had such a stressful time trying to find legal help. I felt lost and hopeless when I got a notice to appear at the LTB. When I found Ryan, he stepped up and defended me. He’s knowledgeable about both the LTB and criminal law, and most importantly he’s tough! Exactly what I was looking for. I’m so glad I found him.
Ryan is a tough lawyer who defended us during a very difficult time. He helped me with a Landlord and Tenant Board issue. People told me to get a paralegal, but the ones I contacted either wouldn’t help or couldn’t communicate well in English. When I found Ryan, he explained the situation clearly and told me what to do. He showed up to the hearing tough and ready to go. I’m so glad I found him!
One of the best. Well poised, smart articulate. Know his stuff and one of the best lawyer out there to work with.

From My Experience: The Best Prenups Bring Couples Closer
I understand why the word "prenup" makes some couples uneasy at first. But in my experience, the couples who go through this process together — openly, with enough time — almost always come out of it feeling more confident about their finances and their marriage, not less.
What Surprises Clients Most
Clients are often surprised by how much clarity the process brings. Many couples have never had a truly detailed conversation about debts, spending habits, or long-term financial goals before beginning a prenup, and that conversation itself often turns out to be valuable.
My advice to every engaged couple is simple: start the conversation early, be completely honest with each other about your finances, and treat the process as an investment in your marriage rather than a hedge against it. Call 416-274-2222 to get started well before your big day.
