The single most important thing I tell every client in a contractor dispute: get an independent assessment of the work in writing before you do anything else. A report from a qualified inspector or tradesperson — explaining what was done wrong, what it does not meet code, and what it will cost to fix — is the foundation of your claim. Courts in Ontario want objective evidence of defects, not just your account of what you were dissatisfied with.

The Counterclaim Problem

One thing that surprises many clients: when you sue a contractor, they often file a counterclaim saying you owe them additional money for extras, change orders, or work completed.
