If your family law matter can’t be resolved by agreement, it will be filed at the Superior Court of Justice — Family Court branch, at the Lieutenant-Colonel Samuel S. Sharpe Courthouse, 150 Bond Street East, Oshawa. Because Oshawa is a Unified Family Court site, every family law issue — divorce, parenting, support, property, and child protection — is handled by one court, rather than being split between two different levels the way it is in some other regions.
Most contested matters begin with the Mandatory Information Program (MIP), a short session most parents are required to attend before their case can move forward. MIP explains how the court process works, how separation affects children, and what options — like mediation — exist outside of a full court application. The courthouse also has an on-site Family Law Information Centre (FLIC), staffed to answer process questions and connect parents with court-connected mediation services, which can resolve many parenting and support issues without a judge.
For matters that don’t resolve early, a contested case generally moves through a series of court dates rather than straight to a trial: an application starts the process, followed by a case conference (where a judge helps identify the real issues and encourages settlement), a settlement conference (a more focused attempt to resolve the matter), and, if needed, a trial management conference before an actual trial. Most family law cases in Durham Region — and across Ontario — settle at one of these earlier stages rather than proceeding all the way to trial.
Some situations can’t wait for the regular schedule of conferences. If a child is at risk, a parent is being denied all contact without reason, or another urgent parenting issue arises, it’s possible to bring an urgent motion asking the court to act on a shortened timeline. These motions are reserved for genuinely time-sensitive situations, and a judge will expect clear evidence of why the normal process isn’t fast enough.
