Before a contested parenting case can move forward at the Oshawa courthouse, parents are generally required to attend the Mandatory Information Program (MIP) — a short session covering how the court process works, the impact of ongoing conflict on children, and options like mediation that can resolve a parenting dispute without a full court process.
From there, most parents are expected to work toward a parenting plan — a written document setting out decision-making responsibility and the parenting-time schedule. Government-published parenting-plan guidance and templates exist as a starting point, but a plan that is specific enough to actually hold up usually needs more than a generic template.
If parents can’t agree on their own, the first court step for a contested matter is usually a case conference, where a judge reviews the file, helps identify the real issues in dispute, encourages settlement, and sets a timetable for what happens next if the matter doesn’t resolve. Most parenting cases settle before trial, often at or shortly after this stage, once both sides understand where a judge is likely to land.
In some cases, the Office of the Children’s Lawyer (OCL) — a government office independent of both parents — becomes involved, usually at the court’s request. The OCL can prepare a report on the child’s views and circumstances, or in some cases provide the child with legal representation; it has its own criteria for which cases it accepts and typically has a waitlist.
Where the dispute is more complex, a court can order a parenting assessment under section 30 of the Children’s Law Reform Act — a privately paid, independent assessment, usually by a psychologist or social worker, of the family’s circumstances and each parent’s ability to meet the child’s needs. It can include recommendations for a parenting plan, and is a different process from an OCL report.

How Parenting Time Affects Child Support
Parenting time and child support aren’t decided in isolation — under section 9 of the Federal Child Support Guidelines, the amount of time each parent has the child with them can change how support is calculated. The standard approach uses the paying parent’s income and the applicable support table. But when each parent has the child at least 40% of the time over the course of a year, the shared-parenting approach under section 9 applies instead: the court considers both parents’ table amounts, the increased costs of maintaining two households for the child, and each parent’s and the child’s circumstances, means, and needs.
That 40% threshold is why parenting schedules and child support are usually addressed together, not as two separate issues — a schedule that shifts the actual time split can shift what’s owed. We don’t make promises about how a specific schedule will affect your support obligation; every case depends on its own numbers, and that’s exactly the kind of calculation we walk clients through before they agree to a schedule.
