How a Divorce Works at the Durham Courthouse
To file for divorce in Ontario, either you or your spouse must have been ordinarily resident in the province for at least one year immediately before starting the application. The Divorce Act recognizes one ground for divorce — breakdown of the marriage — most commonly shown through one year of separation, though adultery or cruelty can establish grounds without waiting out that year.
Spouses who agree on the divorce and any related issues can file a joint application, which moves faster because there is no need to formally serve the other spouse. Where only one spouse applies, the application must be formally served, giving the other spouse a set period to respond. Under Ontario’s Family Law Rules, a case is generally started in the courthouse for the municipality where a party lives, so Ajax applications are filed with the Superior Court of Justice, Family Court branch, at the Lieutenant-Colonel Samuel S. Sharpe Courthouse in Oshawa — the only court with jurisdiction to grant a divorce in Ontario. Ontario has also been moving family court filing online through the Ontario Courts Public Portal; we confirm current availability for Durham Region matters before relying on it.
An uncontested joint divorce with no other issues outstanding is usually decided on the written court record rather than at a hearing — once the paperwork is complete, the parties file an affidavit for divorce and a judge reviews the file on paper. Before granting any divorce, the court must also be satisfied that reasonable arrangements have been made for the support of any children of the marriage, consistent with the Child Support Guidelines.
A divorce order does not end the marriage immediately — it takes effect 31 days after the order is made, which is also the earliest either spouse can remarry. Once that period has passed, you can request a certificate of divorce from the court as proof the divorce is final.

Three things come up again and again with Ajax clients. First, document your separation date as soon as it happens — a text, an email, or a note of when one of you moved out, or began living separate lives under the same roof, is often the only evidence of when the clock started running. Second, think carefully before moving out of the matrimonial home: Ontario’s Family Law Act treats the matrimonial home differently from other property, and leaving it doesn’t give up your rights to it, but the decision still has real consequences and is worth discussing with a lawyer first. Third, keep the equalization deadline in mind — a claim to divide property generally has to be started within two years of the divorce or six years of separation, whichever comes first, so that clock doesn’t stop just because the divorce itself is finished.
