To get a divorce in Ontario, you must have been legally married, at least one spouse must have lived in Ontario for the 12 months before filing, and you must show a breakdown of the marriage. The most common ground is living separate and apart for at least one year; adultery and cruelty are the other grounds and do not require the one-year wait. You can file before the year is complete, but the divorce is not granted until the separation year has passed.
