Frequently Asked Questions
How much does a civil lawsuit cost in Ontario?
It varies enormously with the court, complexity, and how far the matter goes. A demand letter may cost a few hundred dollars, a Small Claims Court matter through trial a few thousand, and a contested Superior Court action tens of thousands or more. This tool gives a rough planning range only.
Can I recover my legal costs if I win?
Usually only a portion. In Ontario the successful party generally recovers partial-indemnity costs from the losing side — rarely the full amount — and cost awards in Small Claims Court are capped. Factor that into your cost-benefit analysis.
Is it cheaper to settle than to go to trial?
Almost always. The bulk of litigation cost is incurred preparing for and running a trial, which is why most civil matters settle beforehand. A settlement can save substantial cost and risk on both sides.
Does a bigger claim cost more to pursue?
Not always directly, but larger claims tend to be more complex and are more often in Superior Court, where procedure is more involved and costly. The complexity of the dispute usually drives cost more than the dollar amount alone.
