What is the Small Claims Court limit in Ontario?
Ontario’s Small Claims Court hears claims up to $50,000, excluding interest and costs. Claims above that amount generally proceed in the Superior Court of Justice, unless you choose to cap your claim at $50,000.
Can Small Claims Court grant an injunction?
Generally no. Small Claims Court can usually only order the payment of money or the return of personal property. If you need an injunction, a declaration, or another non-monetary remedy, your matter belongs in the Superior Court of Justice.
Should I cap my claim to stay in Small Claims Court?
Sometimes. If your claim is somewhat over $50,000, abandoning the excess to stay in the faster, cheaper Small Claims Court can be worthwhile — but you give up the amount over $50,000. Weigh the savings against what you forgo, ideally with legal advice.
Why does the choice of court matter?
Small Claims Court is faster, less formal, and much less expensive, and it caps cost awards. The Superior Court can handle larger and more complex matters and grant more remedies, but with more procedure and cost. Choosing the right venue at the outset avoids wasted time and money.
