Custody terminology in Ontario has shifted to "decision-making responsibility" and "parenting time."In Ontario, 'custody' and 'access' are now called decision-making responsibility and parenting time under the Divorce Act and Children's Law Reform Act. Parenting arrangements are decided on the best interests of the child, not a preset formula. The share of parenting time matters for support: where each parent has the child at least 40% of the time, child support is usually calculated by setting off both parents' Child Support Guidelines table amounts rather than one parent paying the full table amount.
Section 9 of the Federal Child Support Guidelines applies once a parent has at least 40% of overnights, changing how support is calculated.
Under s.8, if you have multiple children and each parent has majority residence of at least one, support is calculated as a set-off between each parent's Table amounts.
Since 2021, Ontario law uses "decision-making responsibility" and "parenting time" instead of "custody" and "access" — though the concepts remain similar.
