Our Approach
How We Handle Your Property Division
We review your assets, debts, and the date of marriage, cohabitation, and separation, and explain what equalization will likely look like — no charge, no obligation.
We gather full and sworn financial disclosure from both spouses as of the valuation dates — this is the foundation of every equalization calculation.
We value every asset and debt, apply exclusions where they genuinely apply, and calculate each spouse's net family property.
We negotiate firmly to reach a fair equalization settlement wherever possible, whether as part of a separation agreement or a divorce.
Where agreement isn't possible, we bring or defend equalization applications and advocate forcefully on your behalf.
Once an equalization payment is ordered or agreed, we help enforce it if the other spouse fails to pay.

Valuing and Dividing a Cottage in a Barrie Equalization Claim
A second, seasonal property is one of the most common complications in a Barrie equalization claim. If a cottage was owned by one spouse before the marriage, the value it had on the date of marriage can potentially be excluded — but any increase in value during the marriage is still included, and that increase needs its own proper appraisal rather than a guess.
We also address who can access or use the cottage while a claim is pending, since seasonal properties raise scheduling questions a year-round home simply does not.

From My Experience: What Barrie Clients Should Know About Property Division
A cottage needs its own appraisal, not a guess
I've seen Barrie clients try to value a cottage off the top of their head, and it's almost always wrong in one direction or another. A proper appraisal, split between date-of-marriage and current value when relevant, protects both spouses.
Pre-marriage value only protects what actually grew during the marriage
Clients sometimes assume owning a cottage before the marriage excludes the whole thing. It only excludes the value it had on the date of marriage — the growth since then is still on the table.
Seasonal access becomes its own negotiation
Who gets the cottage for the summer while a claim is pending is a question I get constantly from Barrie clients, and it's worth addressing early rather than leaving it to chance.
Equalization math doesn't change between Barrie and anywhere else in Ontario
The Family Law Act applies the same way here as it does in Toronto. What's different in Barrie is simply how often a second property shows up in the file.
