In Ontario, the portion of a workplace or government pension earned during the marriage is family property and is included in equalization of net family property. For most registered pensions, the plan administrator calculates the 'Family Law Value,' and up to 50% of the value accrued during the marriage can be transferred to the other spouse using the prescribed FSRA family-law forms. Common-law partners are not entitled to divide a pension through equalization.
