Does every criminal charge result in a criminal record?
No. Outcomes such as withdrawal of the charge, a peace bond, participation in a diversion program, or an absolute or conditional discharge can all avoid a formal criminal conviction, depending on the charge and your circumstances.
Does this wizard guarantee I will avoid a record?
No. This tool identifies the factors relevant to your specific situation and helps you understand your options — it does not guarantee diversion, a discharge, or any other outcome, which is ultimately determined by the Crown and the court based on the full evidence.
What is the difference between an absolute and conditional discharge?
Both result in a finding of guilt without a formal conviction. An absolute discharge has no conditions attached and is automatically removed from most record checks after one year. A conditional discharge requires you to comply with probation conditions, and is removed after three years once those conditions are satisfied.
What is diversion or alternative measures?
Diversion (sometimes called alternative measures) allows some accused people — often first-time offenders facing less serious, non-violent charges — to complete conditions such as community service, counselling, or restitution in exchange for the Crown withdrawing the charge, avoiding a trial and a record.
Will a discharge still show up on a background check?
It depends on the type of check.
