Common Questions
Frequently Asked Questions
How soon does a bail hearing happen after arrest?
Ontario law generally requires that a person in custody be brought before a justice within 24 hours of arrest, or as soon as reasonably possible if a justice is not available within that time.
Does this wizard predict whether I will get bail?
No. This tool identifies the factors relevant to your specific situation and helps you prepare your release plan and evidence — it does not predict the outcome of a bail hearing, which depends on the charge, the evidence, and the judicial officer hearing the matter.
What is a surety and do I need one?
A surety is a person who supervises your release, ensures you comply with your conditions, and pledges an amount of money that can be forfeited if you breach your release. Whether one is required depends on the charge, your record, and the Crown's position — for many charges, release on your own recognizance without a surety is possible.
What is the "ladder principle" in Ontario bail law?
It requires the court to consider the least restrictive form of release first, moving up a "ladder" of options (from release on a simple promise, to release with conditions, to release with a surety, to detention) only as needed to address specific concerns about attendance, public safety, or confidence in the justice system.
What happens if I breach my bail conditions?
Breaching a release condition is itself a separate criminal offence and can result in your bail being revoked, additional charges, and significantly harder terms if you are released again in the future.
