The Charge
Common Questions
Frequently Asked Questions
What happens at a first court appearance in Ontario?
Nothing is decided. The first appearance is administrative: the court confirms the charge, defence requests disclosure (the police and Crown evidence), and the matter is adjourned. You do not enter a plea, no trial happens, and having a lawyer appear for or with you is routine.
Will a first offence give me a criminal record?
Not necessarily. Many first charges — especially minor property offences — resolve through diversion (charge withdrawn after completing a program), a peace bond (charge withdrawn in exchange for conditions), or an absolute or conditional discharge (a finding of guilt without a conviction). Each path has different consequences for background checks, which is why the resolution choice matters.
What is diversion and who qualifies?
Diversion (alternative measures) lets eligible accused complete requirements like community service, a charitable donation, or counselling in exchange for the Crown withdrawing the charge. Eligibility is Crown policy, not a right — it is most available for first-time, low-value, non-violent offences, and raising it early improves the odds.
Should I just plead guilty to get it over with?
Almost never at the start. Pleading guilty at an early appearance forfeits diversion, withdrawal, and defence options before anyone has seen the evidence — and a conviction is permanent. The fastest safe resolution comes from reviewing disclosure and negotiating with the Crown, which a lawyer can often do within a few appearances.
Can I talk to the police to explain my side?
You have the right to remain silent, and using it is not evidence of guilt. Statements to police rarely help and routinely hurt — misremembered details become inconsistencies. Explanations are for your lawyer to deliver, in the forum where they help you.
Do I need a lawyer for a minor first charge?
The outcomes that protect your future — diversion, withdrawal, discharge — are negotiated outcomes, and negotiation is where representation earns its fee. Many firms, ours included, offer free consultations and flat fees for first-charge matters, so you can price the decision before making it.
