Careless driving is a provincial offence, distinct from Criminal Code dangerous driving.In Ontario, careless driving under section 130 of the Highway Traffic Act carries a fine of $400 to $2,000, up to six months in jail, a licence suspension of up to two years, and six demerit points. The more serious offence of careless driving causing death or bodily harm raises the maximum fine to $50,000 and jail to two years. Every fine also attracts a victim fine surcharge and court costs.
